Terms of Service — Pagey Site

Please read these Terms of Service ("Terms") carefully before using Pagey Site (the "Service"), operated by Pagey Site ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts

You may use certain features of the Service without creating an account. To access account-bound features (such as site ownership, version history, and API access) you must register with a valid email address and keep your password confidential. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period on free plans.

3. Acceptable Use

You agree not to use the Service to host, upload, or distribute content that:

Is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene;
Infringes the intellectual property rights of any third party;
Contains malware, viruses, phishing pages, or other malicious code;
Constitutes spam or unsolicited commercial communications;
Violates the privacy or personal data rights of any individual;
Impersonates any person or entity.

We may remove any content and suspend or terminate any account that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users, third parties, or the Service.

4. Content Moderation & Automated Review

To maintain the safety and integrity of the Service, we use automated systems, including machine learning models, to analyze content hosted on the platform.

These systems may review, without limitation:

Visible text content of hosted pages;
Links and external references;
Image filenames, URLs, and associated metadata;
Page titles, meta tags, and structural or behavioral patterns.

Content may be evaluated for categories including, but not limited to, adult content, phishing, malware, harassment, hate speech, spam, and illegal goods or services.

Based on this analysis, we may take action at our sole discretion, including:

Allowing content without restriction;
Flagging content for manual review;
Restricting, suspending, or disabling access to content;
Suspending or terminating accounts.

You acknowledge and agree that automated moderation systems are probabilistic in nature and may result in false positives or false negatives. We do not guarantee the accuracy, completeness, or reliability of such systems or their outputs.

You remain solely responsible for the content you publish and for ensuring it complies with these Terms and applicable laws.

If you believe your content has been incorrectly restricted or removed, you may contact us at contact@pagey.site. We are not obligated to restore content but may do so at our discretion.

5. Content Ownership & License

You retain all ownership rights to the content you upload. By uploading content to the Service you grant us a limited, non-exclusive, royalty-free license to store, serve, and display your content solely for the purpose of operating the Service. We do not claim ownership of your content.

You are solely responsible for ensuring you have the rights to publish any content you upload.

6. Anonymous Sites & Data Retention

Sites created without an account ("anonymous sites") may be subject to automatic expiry and deletion after a period of inactivity, as determined by your plan tier. We are not responsible for loss of anonymous site data.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

8. Paid Plans & Billing

Certain features require a paid subscription. Fees are billed in advance on a recurring basis as described at the time of purchase. You authorize us to charge your payment method on each billing cycle. All fees are non-refundable except where required by law or explicitly stated otherwise.

We reserve the right to change pricing with reasonable advance notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.

9. Intellectual Property

All trademarks, service marks, logos, and intellectual property associated with the Service (excluding user-uploaded content) are owned by or licensed to Pagey Site. Nothing in these Terms grants you any right to use them without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Pagey Site AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

12. Indemnification

You agree to indemnify and hold harmless Pagey Site and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the courts located in Delaware.

14. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
